[Abstract(Law)] A Study on the Measures to Facilitate Antitrust Compliance Programs

The Antitrust Compliance Program (CP) introduced in 2001 to promote a culture of corporate compliance. However, it later deviated from its original objective, focusing on the appropriateness of the introduction of the CP to reduce the administrative fines. In this way, the reduction of administrative fines by CP was finally abolished in 2016, and the incentives of companies for CP were greatly undermined. In addition, active efforts to promote CP have not been made, and only a small number of companies apply for CP grading. In order to enhance the compliance culture between companies and reverse the downward trend, the following two measures need to be taken. First, in order to reintroduce the reduction of administrative fines based on CP, the grading standards and procedures should be improved to better distinguish paper and effective compliance. Second, active measures such as education, consulting, and financial assistance are necessary to promote CP among business enterprises.
